1. Acceptance of Terms
By accessing or using aImsg ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
These terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.
2. Description of Service
aImsg provides a service that allows users to interact with their GitHub repositories via text message using AI-powered analysis. The Service includes:
- AI-powered code editing and review via text message
- Repository question answering
- Code editing suggestions
- Integration with GitHub OAuth
- Support for multiple AI providers (Claude, GPT, Gemini)
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or attempt to harm the Service
- Attempt to gain unauthorized access to other users' accounts
- Use the Service for spam or fraudulent activities
- Reverse engineer or attempt to extract source code
5. API Keys and Third-Party Services
The Service requires you to provide API keys from third-party AI providers. You acknowledge that:
- You are responsible for obtaining and maintaining valid API keys
- Your use of third-party services is subject to their respective terms
- We are not responsible for charges incurred through your API usage
- API keys are encrypted and stored securely using AES-256 encryption
6. Payment and Billing
Certain features of the Service require a paid subscription. By subscribing, you agree to the following:
- Billing: All payments are processed through Stripe. We do not store your payment card details.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Plan Changes: You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of the next billing period.
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until then.
- Refunds: We generally do not provide refunds for partial billing periods. If you believe you have been charged in error, please contact us at admin@aimsg.dev within 14 days.
- Free Trial: New accounts receive 10 free messages. The trial does not require a payment method. Once the free messages are used, a subscription is required to continue using paid features.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by aImsg and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any code or content you submit through the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.
8. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIMSG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
AI-generated code suggestions should be reviewed before implementation. We are not responsible for any issues arising from the use of AI-generated content.
9. Disclaimers
The Service uses artificial intelligence to generate code suggestions, reviews, and responses. You acknowledge and agree that:
- No Guarantee of Accuracy: AI-generated code, suggestions, and analysis may contain errors, bugs, or security vulnerabilities. You are solely responsible for reviewing and testing any code before deploying it to production.
- Not Professional Advice: The Service does not constitute professional software engineering, legal, or security advice. For critical systems, consult qualified professionals.
- Service Availability: We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
- Third-Party Dependencies: The Service depends on third-party providers (GitHub, AI providers, messaging infrastructure). We are not responsible for outages or changes in these third-party services.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which should survive termination shall survive.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you consent to the personal jurisdiction of such courts.
13. Dispute Resolution
In the event of a dispute arising from or relating to these Terms or the Service:
- Good Faith Resolution: The parties agree to first attempt to resolve the dispute informally by contacting each other at admin@aimsg.dev. We will make good faith efforts to resolve any complaint or dispute within 30 days.
- Binding Arbitration: If the dispute cannot be resolved informally, either party may elect to have the dispute resolved by binding arbitration administered by a recognized arbitration organization in accordance with its rules. The arbitration will be conducted in English in California, United States.
- Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
- Small Claims Exception: Either party may bring a claim in small claims court if the claim qualifies for such court.
